Finlay provides its clients with a high degree of
sophistication in the field of international arbitration
law. We have experience in the arbitration of commercial
disputes and in particular, international commercial
cases, both as counsel and as arbitrator. We have
a broad base of experience in a variety of commercial
areas from admiralty law to construction law involving
disputes ranging from breach of contract to fraud
and breach of fiduciary duty. Our experience in 2003-2004
includes acting as arbitrator in a $100 million dispute
between a Japanese company and an American company
involving a technology sharing agreement and a multi-million
dollar dispute between an American company and a
Turkish company related to international telecommunications
and data transfer agreements. We also acted as counsel
recently in two construction cases involving major
projects as well as in other complex arbitrations.
We have experience in international cases in Canada,
the United States and Europe under the rules of UNCITRAL,
ICC and AAA, applying the laws of a number of different
jurisdictions.
Arvay Finlay is experienced in advising clients
on all aspects of international arbitration law
from the drafting of arbitration agreements to
the enforcement of foreign arbitral awards under
the New York Convention.
