Arvay Finlay has been involved in some of the most significant and complex aboriginal law cases in Canadian history. We acted for the Province of British Columbia in the most significant aboriginal land claim case in Canada to date, R. v. Delgamuukw. We also acted for the Province in defending a constitutional challenge to the Nisga’a Treaty. We are currently acting for the Haida in their claim to aboriginal rights and title in Haida Gwaii. This year, our firm acted in a major case involving provincial tribunals and aboriginal rights, ultimately prevailing in the Supreme Court of Canada - Paul v. Forest Appeals Commission.

Arvay Finlay’s expertise in the field of aboriginal law makes it ideally suited to advise and act for aboriginal clients with respect to their claims to aboriginal rights and title.

In addition to our litigation experience, Arvay Finlay has long standing experience in the mediation and compromise of aboriginal issues. For example, Murray Rankin has served a treaty negotiator in several negotiations across BC, and succeeded in negotiating an Agreement in Principle with the Sechelt First Nation and an adhesion to Treaty No. 8 with the McLeod Lake Indian Band.

Given the breadth of our experience in aboriginal matters, our firm is also well-placed to assist First Nations and companies in this complex and dynamic field of law. Areas in which we have been involved include: land claims; treaty negotiations; project approval; legislation; taxation; business opportunities for First Nations; environmental issues; and consultation methods and agreements.
